Legal Framework
Ley fundacional de seguridad vehicular en EE.UU. Autoriza a la NHTSA a emitir estándares de seguridad obligatorios (FMVSS) y a ordenar recalls cuando un vehículo presenta un defecto de seguridad.
Amplió la autoridad de la NHTSA para investigar y forzar recalls. Obliga a los fabricantes a reportar al gobierno cualquier dato de defectos conocidos dentro de los 5 días de tomar conocimiento.
Codificación que establece la obligación del fabricante de notificar a propietarios, compradores y distribuidores sobre cualquier defecto de seguridad relevante, dentro de los 60 días de la determinación.
What to do about a recall

Buscá tu VIN (número de identificación del vehículo, 17 dígitos) en el portal oficial de la NHTSA: nhtsa.gov/recalls.

Si tu vehículo está afectado, contactá al concesionario oficial de tu marca. La reparación es siempre gratuita.

Si el concesionario no tiene las partes disponibles, registrate en la lista de espera. Tenés derecho a un reemplazo gratuito si la demora es irrazonable.

Para presentar una queja o reportar un defecto no conocido, usá SaferCar.gov o llamá al 1-888-327-4236.

Si creés que el vehículo representa un riesgo inminente, podés solicitar una investigación formal a la NHTSA.
Where to file a claim
Las quejas se presentan en SaferCar.gov. La NHTSA analiza los patrones de quejas para abrir investigaciones. Si acumulan suficientes reportes, pueden obligar al fabricante a emitir un recall aunque este se niegue.
Your rights as a consumer
Reparación gratuita: el fabricante paga 100% del costo de la reparación del recall (49 U.S.C. § 30120).
Plazo máximo de cobertura: 15 años para vehículos, 10 años para neumáticos.
Notificación obligatoria: el fabricante debe notificar por correo postal a todos los propietarios registrados.
Reembolso por reparación previa: si pagaste de tu bolsillo una reparación que luego resultó ser un recall, podés solicitar reembolso.
Recall forzado: si el fabricante se niega, la NHTSA puede ordenarlo judicialmente y aplicar multas de hasta $115 millones.
